The Sixth Appellate District reversed a judgment of sentence and remanded. The court held that the sentencing court violated Apprendi v. New Jersey (2000) 530 U.S. 466 in resolving by itself the disputed facts of a prior conviction in order to conclude that the crime constituted a serious felony for purposes of sentencing under the Three Strikes law.
