SAN FRANCISCO — Three Ninth Circuit judges have dissented from a ruling last year that upheld California’s ban on therapy aimed at changing minors’ sexual orientation.
Judges Diarmuid O’Scannlain, Carlos Bea and Sandra Ikuta said the court should have considered the First Amendment implications of the ban, even if doing so would not necessarily have changed the outcome of the case.
