The court of appeals reversed a district court judgment denying a petition for writ of habeas corpus. The court held that a defendants constitutional right to confront adverse witnesses was violated where he was precluded from eliciting cross-examination testimony from his wife that she was afraid to deviate from her original incriminating statement to police because of threats allegedly made against her by the prosecutor.
