Norfolk Southern Corp., faced with potentially hundreds of millions of dollars in costs from its derailment in East Palestine, Ohio, is hoping to reroute liability by pointing fingers at the companies that owned the railcars and shipped the toxic chemicals.
On June 30, Atlanta-based Norfolk named six companies, including Dow Chemical Inc. and GATX Corp., in a third-party complaint as part of the lawsuit filed by Ohio Attorney General Dave Yost. Norfolk lawyer Davina Pujari of Wilmer Cutler Pickering Hale and Dorr in San Francisco said those companies shared responsibility for the Feb. 3 incident.
