Burger King was hit with a consumer class action Monday in California Northern District Court alleging that packaging for the company’s ‘Whopper’ burger contains harmful per- and polyfluoroalkyl substances (PFAS). The court action, filed by Bursor & Fisher, contends that Burger King fails to disclose the presence of PFAS in its packaging and brings claims for fraud, negligent misrepresentation and negligent failure to warn as well as for alleged violations of California consumer protection laws. Counsel have not yet appeared for the defendant. The case is 4:22-cv-02258, Hussain v. Burger King Corporation.
