In a first-of-its-kind lawsuit, a Florida franchise has accused Google of illegally slapping restaurant names on its own online ordering sites to deceptively direct customers to delivery providers like Grubhub and Postmates.

Lime Fresh Mexican Grill, which has six locations in Miami, filed the class action Tuesday on behalf of restaurants nationwide whose trade names end up on Google’s online ordering sites without their permission in violation of the Lanham Act, the federal trademark law. Although Google’s sites display accurate information to customers, including menu items, restaurants are forced to pay up to 30% of the orders to delivery providers, a portion of which goes back to Google, the lawsuit says.
