A federal judge’s “independent research and extra-record evidence” prompted an appellate court on Thursday to vacate a broad injunction that blamed decades of institutional racism for homelessness in Los Angeles.

A three-judge panel with the U.S. Court of Appeals for the Ninth Circuit concluded that the plaintiffs in the civil rights lawsuit didn’t put forth evidence to support the claims that U.S. District Judge David Carter deemed valid in his 110-page injunction in April, which called for housing offers for all Skid Row residents by October and mandated audits on spending and reports on finances and property.
