A Lackawanna County judge has ruled that a snowmobile club operator is liable for injuries sustained by a man after his ride crashed into a hidden six-foot-deep gully on one of the trails, but that the landowner is not negligent.

On June 7, 2014, plaintiff Randie Mullen, in her early 50s, was shopping at a Sam's Club in West Mifflin. A 40-pound bucket of chlorine tablets fell from a display that was more than 4 feet high, onto her right lower leg. She claimed injuries of her leg, back and hip.

The Pennsylvania Superior Court rejected an attempt by the plaintiff to compare the facts of the case to those in Marshall v. Brown's IA, in which the court ruled that defendant ShopRite should have been sanctioned for spoliation of evidence after giving only partial surveillance evidence of a slip-and-fall.

On Sept. 29, 2015, plaintiff Curtis Winstead, 40, an owner of a home remodeling business, was a patron at a Texas Roadhouse restaurant in Bridgeville. He slipped and fell while on the property. Winstead claimed head injuries.
