The judge overseeing the Xarelto mass tort in Philadelphia is considering a flurry of motions and responses that are expected to shape the state court litigation as it is gearing up for next month’s bellwether trial.
Philadelphia Court of Common Pleas Judge Arnold New has been assigned a series of summary judgment motions on several issues, from whether punitive damages should be allowed into the case, to whether the plaintiffs claims are pre-empted by federal law.
