Not having enough money is no excuse for an oil and gas company on the hook for a $260,000 settlement to not live up to its agreement, a federal judge ruled Tuesday.

Benton Energy Service Co. told a Pittsburgh federal judge that it couldn’t make the agreed-upon installment payments in a Fair Labor Standards Act class action against it, pointing to financial hits the company has taken from the downturn in the energy industry. Meanwhile, the class members asked the court to enforce the settlement.
