As a mediator, I often wonder if the parties involved in a dispute achieved all that they could have before the mediation ended. If the matter is resolved, could it have been settled on more favorable terms for one party or the other? If the mediation ended without an agreement, did the parties gain better information that will enable them to improve their chances at trial or cause them to modify their position on settlement?
