During the first six terms of the Roberts Court (2005-10), the U.S. Supreme Court heard more than 460 cases, 16 of which were on review from the 3rd U.S. Circuit Court of Appeals. Importantly, however, when one takes into account cases presenting circuit splits, the Supreme Court in fact reviewed 68decisionsfrom the 3rd Circuit.

This article examines the Roberts Court’s affirmances and reversals of all of these 3rd Circuit decisions, and concludes that the 3rd Circuit has an outstanding “success” rate — i.e., lower reversal rate — significantly better than previously recognized.
