In a recently published opinion, the Pennsylvania Commonwealth Court in Chaffier v. Hellertown Borough Zoning Hearing Board, Pa. Commw. Unpub. LEXIS 30 (Jan. 10, 2024), struck down an attempted change in a property’s zoning classification as illegal spot zoning.

In late 2019, the property owner in Chaffier applied to the local government in Hellertown Borough to change the zoning classification of the property at issue from R-1 to R-2, the opinion said.
