A divided Pennsylvania Superior Court narrowly determined that the owner of a natural gas well site and a company contracted to drill on it can be held liable in a personal injury suit from a subcontracted worker.
The majority in the 5-4 decision found that the defendants were not statutory employers subject to tort liability immunity, in part because the injured worker’s job wasn’t a “regular or recurrent part” of the defendants’ business.
