The Pennsylvania Supreme Court is set to hear arguments over whether the odor of pot amounts to probable cause for police to search a vehicle during a traffic stop given that medical marijuana is now legal in the state.

In an order in Commonwealth v. Barr II issued Wednesday, the justices agreed to consider argument related to defendant Timothy Barr II’s habeas corpus appeal and petition to suppress evidence obtained from a vehicle search that led to charges of illegal possession of a firearm stemming from a gun found in a jacket allegedly belonging to Barr.
