On Dec. 19, 2015, plaintiff Arshad Khan, 38, a taxicab driver, was stopped at a traffic light on Market Street, at its intersection with 16th Street, in the Center City area of Philadelphia. Kahaalil Branch pulled up to Khan’s vehicle, pointed a paintball gun at Khan and shot him in the right eye. Khan later lost his eye.
