A Pennsylvania appeals court has determined that the Housing Authority of Indiana County acted improperly when it simply deferred to federal law in denying a woman’s application for the Section 8 housing voucher program over the fact that she was a medical marijuana user.

Instead, a divided three-judge Commonwealth Court ruled that the housing authority must establish its own standards for determining “when and on what basis admission is prohibited for an applicant legally using medical marijuana pursuant to a valid Medical Marijuana Identification Card.”
