A federal judge in Pennsylvania has dismissed most of a lawsuit against Rite Aid over allegedly misleading nutrition supplement labeling, allowing only an unjust enrichment claim to move forward.

U.S. District Chief Judge Christopher C. Conner of the Middle District of Pennsylvania granted Rite Aid’s motion to toss a request by plaintiffs Kaley Diann Silva and Lindsey Avenetti for injunctive relief, as well as their claims for breach of contract, implied warranty, express warranty and fraudulent misrepresentation.
