Tort reform’s imposition of caps on damages means that medical-malpractice cases offer fewer financial rewards for most Texas plaintiffs lawyers. But San Antonio solos Per Hardy and James Hoffman found a way to make such a case pay, after successfully casting the loss of a wife and mother’s household services as economic damages.
On May 9, U.S. District Chief Judge Fred Biery of the Western District of Texas issued a $687,000 final judgment for "household services." That’s in addition to a $1.8 million final judgment in medical expenses and damages Biery previously had awarded to the clients of Hardy and Hoffman.
