A Dallas personal injury law firm prevailed at the Fifth District Court of Appeal, which affirmed a trial court’s denial of summary judgment in its defamation suit against a chiropractor.
The appeal raised an issue of first impression for the Fifth District and resulted in a conflict between the Fifth District and its sister courts as to how to proceed with a Texas Citizens Participation Act, or TCPA, analysis.
