'Serious Impact' Must Be Shown to Meet AICRA's Verbal Threshold
Settling an issue that divided trial judges, an Appellate Division panel ruled in James v. Torres, that automobile injury victims must prove that a permanent injury has a serious impact on their lives in order to satisfy the Automobile Insurance Cost Reduction Act's verbal threshold, even though AICRA makes no mention of "serious impact," in Oswin v.
