Five years after passage, New Jersey's Affidavit of Merit Act is accomplishing some of its goals -- dissuading tort litigation -- but in pernicious ways. The New Jersey Supreme Court heard arguments last week from plaintiffs' lawyers licking their wounds over lost cases because of a lawyer's failure to obtain or file the affidavit on time, and litigation fees that outweigh damages recovered.
