Drug Companies Must Warn Patients

The New Jersey Supreme Court ruled last week that when prescription drug companies directly market their products to consumers without providing adequate safety warnings, they can't seek cover by showing they provided product information to physicians. The Court held that Wyeth Laboratories -- the manufacturer of the Norplant contraceptive -- can be sued because a massive advertising campaign in the early 1990s failed to warn women of any dangers or side effects associated with the device.
