State High Court Voids Death Sentence

As a small boy, Larry Lucas was regularly beaten by his parents and grandmother, fed very little food, dressed in rags during brutal Midwest winters and punished with cigarette burns. None of that, however, was mentioned as mitigating evidence during the trial at which Lucas was sentenced to death for two murders. On Monday, in an opinion written by Chief Justice Ronald George, the California Supreme Court ruled unanimously that the absence of that information was enough to negate Lucas' death sentence.

9th Circuit Paves New Ground for Laptop Searches

The 9th Circuit has ruled that border guards may search and seize the contents of laptop computer files without probable cause, even if the contraband material is contained only in the computer's temporary cache memory. The ruling expands the notion of possession and control of computer material, in a boon to prosecutorial power to win convictions in Internet child porn possession cases. The ruling also means U.S. citizens may face warrantless searches, without probable cause, at the U.S. border.

So far, the fight to reform California's unfair competition law has seemed more showbiz than substance. There's a skeletal bill from Assemblyman Lou Correa that has yet to take shape. Tort reformers pushing for change have yet to reveal exactly what they want. And even though there isn't a proposal on the table, the plaintiffs bar is warning of potential disaster. What is clear is that legislators are facing a tough choice: either anger trial lawyers or alienate business interests.
