Despite recent Third Circuit predictions that Pennsylvania soon would adopt the Restatement (Third) of Torts and its formulation of the test for strict products liability, the court felt that given the Pennsylvania Supreme Court's even more recent decision to decline to adopt that Restatement and instead dismiss the appeal where that issue was the focal point as improvidently granted, it was required to rely on the Second Restatement's formulation in section 402A.
