New Jersey Supreme Court Declines to Extend 'Bridgewater-Raritan' Decision to Impose Notification Duty on School Districts

"I am pleased that the Supreme Court agreed with our main argument that the appellate court improperly extended the holding in 'Bridgewater-Raritan' to impose a notice obligation on employers in the absence of a specific statutory provision requiring it," said counsel for the Somerville Board of Education, Marc H. "The Appellate Court's reliance on the Tenure Act in general to impose such a notice requirement would have had far-reaching implications in other contexts so I believe that this is a significant win for school districts throughout the state."
