N.Y. Court Rebuffs Lawyer's Attempt to Sue JCPenney Over DVD Player Offer
A consumer who purchased $100 worth of Dockers-branded apparel did not sustain an injury when he received a seven-inch DVD player instead of the promised eight-inch player as part of a rebate offer, New York state Acting Supreme Court Justice Thomas A. Adams has ruled. Adams granted department store retailer JCPenney's motion to dismiss attorney Benjamin Weinstock's complaint because he failed to state a valid cause of action, therefore denying his application for class action certification.Two Recent Cases Put ERISA in the Spotlight
Without much fanfare, the U.S. Supreme Court and the 2nd U.S. Circuit Court of Appeals each recently rendered a significant decision under the Employee Retirement Income Security Act. The high court's decision addressed the scope of a disability benefit plan administrator's authority, while the 2nd Circuit focused on the scope of damages available under ERISA.
