Dual Fen-Phen Cases Dismissed for Lack of Doctors' Testimony

The coordinating judge of Philadelphia's Complex Litigation Center has dismissed two more fen-phen cases in which physicians who prescribed the plaintiffs diet drugs were not deposed and are currently unavailable to testify. The judge wrote that summary judgments in favor of Wyeth were proper because the plaintiffs could not establish that their doctors would have altered their prescription habits had the pharmaceutical giant issued different warnings concerning the potential risks of the diet drug.

FTC Signs Off on Internet Legal Referrals

Internet services that match lawyers with potential clients have found a new admirer: the Federal Trade Commission. There has been much debate among state bars as to whether the services violate ethical rules and bans on nonlawyer referrals for legal help, but the FTC has concluded that the services are "likely to make it less expensive for consumers to evaluate providers." Anna Ostrovsky of referral service LegalMatch calls the FTC's stance a "powerful endorsement of the industry."

Man Who Settled Vioxx Suit Sues Three Firms and Three Lawyers

An Ohio man who accepted an approximately $100,000 settlement for his Vioxx personal-injury claim has filed a negligence suit against three Houston firms and three Houston lawyers, alleging the defendants made paperwork errors in his case file that reduced the size of his settlement. The plaintiff said that he should have received a settlement totaling more than $436,000.
