Asthma as a Disability

Asthma in the United States has reached epidemic proportions, and with it has come an explosion of claims under the ADA. Most cases in which the plaintiff alleges that asthma is a disability are unsuccessful; often the cases are dismissed on the ground that the plaintiff has not shown that his asthma substantially limits his ability to perform a broad range of jobs. A few recent decisions, however, have permitted asthmatics to prevail on their ADA claims. This article examines the case law.
