Circuit lets insurance mandate live

San Francisco's experiment in universal health care survived a legal hurdle on March 9, when the 9th U.S. Circuit Court of Appeals refused to reconsider a three-judge panel's ruling upholding the city's insurance mandate. Calling it an issue of "exceptional national importance," Judge Milan Smith dissented, joined by seven judges, including Chief Judge Alex Kozinski. Smith argued that the panel's ruling in September upholding the city program threw the circuit into direct conflict with the 4th Circuit.

San Francisco's experiment in universal health care has survived a legal hurdle with the 9th U.S. Circuit Court of Appeals' refusal to reconsider its September ruling, setting up an appeal to the U.S. Supreme Court. On March 9, the 9th Circuit pushed aside a claim by business groups that federal law pre-empts the city's "fair share" program requiring employers citywide to provide coverage for their workers or, in the alternative, to pay a fee for city health clinics.
