New Jersey Appeals Court Curtails Reach of State Consumer Fraud Act

Any sale of consumer goods usually qualifies for protection under New Jersey's Consumer Fraud Act -- one of the nation's toughest laws against disreputable sale practices. But one appeals panel has rethought that propensity for broad interpretation, ruling that consumer goods purchased with the intention of resale do not fall within the law's aegis. Earlier decisions focused on the nature of the goods -- not the character of the buyer or the intended use -- in judging the applicability of the law.

Lawyers Can't Be Sued for Creditor Fraud

The New Jersey Supreme Court declined on Monday to lower the threshold for fraud actions against lawyers whose clients are implicated in schemes against creditors. By a 7-0 vote in a case against a Cherry Hill attorney, the justices declared there is no cause of action against lawyers in New Jersey for the amorphous concept of "creditor fraud," which prohibit acts intended to defraud a creditor even in the absence of common-law fraud elements.
