Big Tobacco scored another significant win Thursday when a divided 3rd U.S. Circuit Court of Appeals court refused to revive a proposed class action civil rights suit brought by African-American smokers who say they were targeted in an aggressive marketing campaign. In Brown v. Chalk up another victory for Big Tobacco. A federal appeals court refused to revive an antitrust and civil RICO suit brought by 16 nonprofit hospitals in Pennsylvania seeking reimbursement of the costs of treating non-paying patients with tobacco-related diseases. The court found the hospitals' claims were based on remote and indirect injuries, and they lacked standing to bring the claims.Quantum Meruit Gives N.J. Firm Clean Sweep in Fee-Collection Suit
A New Jersey law firm stiffed on its fees by a corporate client can collect from the company's principals, a state appeals court held, overturning a ruling that absolved four stakeholders of liability for $116,000 owed to Cole, Schotz, Meisel, Forman & Leonard. The four did not dispute that they benefited from the representation, but argued they shouldn't have to pay the bill because they never agreed to be responsible for it.
