A federal bankruptcy judge in Atlanta has levied a $457.8 million judgment against one of the world's largest forest products companies. Judge Margaret H. Murphy found that, by failing to have licenses for patents, Weyerhaeuser Co. violated contract warranties when it spun off its disposable diaper division as a "liability-laden subsidiary." The judge chastised Weyerhaeuser for producing a generic disposable diaper that infringed on patents held by competitors Procter & Gamble and Kimberly-Clark.

In addition to greatly extending federal jurisdiction over class actions, the Class Action Fairness Act requires defendants to notify state attorneys general and federal regulators of proposed settlement agreements. The purpose of the notification is to prevent attorneys from crafting abusive settlements favoring lawyers over consumers. But few attorneys general have taken up the cudgel. This year, 125 law firms responded to questions about billing rates, which were part of the survey sent to about 300 firms to determine the NLJ 250, the annual list of the nation's 250 largest law firms.
