Capital One's lawyers at McDermott Will & Emery couldn't persuade a Fourth Circuit panel that the bank should be allowed to retroactively change its treatment of credit card late fees and reduce its taxable income by nearly half-a-billion over two years. And despite amicus support from Sullivan & Cromwell's Rodge Cohen, the appellate court also rejected Capital One's bid to deduct the estimated costs of a credit card miles program before customers actually redeemed their miles.

Discount stores will claim to be innocent victims who were fooled by the high quality and high prices of the fakes. In the past, this may have left the trademark owner with little recourse. Recent case law, however, has made monetary remedies easier to achieve -- even absent a finding of willful infringement.
