Capital One's lawyers at McDermott Will & Emery couldn't persuade a Fourth Circuit panel that the bank should be allowed to retroactively change its treatment of credit card late fees and reduce its taxable income by nearly half-a-billion over two years. And despite amicus support from Sullivan & Cromwell's Rodge Cohen, the appellate court also rejected Capital One's bid to deduct the estimated costs of a credit card miles program before customers actually redeemed their miles.
