Appeals Court Upholds Summary Judgment For Hospital
The Georgia Court of Appeals affirmed the grant of summary judgment to Emory-Adventist Inc., d/b/a Emory-Adventist Hospital ("EAH"), in Laura Hunter's medical malpractice suit alleging that an emergency room physician failed to properly treat Hunter's husband for his heart condition, resulting in his death, holding that EAH did not employ the physician and it was protected from vicarious liability because it fully complied with Georgia law in posting a notice in a public area of the hospital regarding the independent contractor status of all or some of the physicians performing services.Deal not grounded by airline industry's woes
