Justice Lewis Stone of the Manhattan Supreme Court has tackled a rarely litigated question in determining whether to vacate an arbitration award by the National Association of Securities Dealers. Facing the issue of whether to apply the state or federal standard, Stone ruled the state standard applied. But, as both he and practitioners note, the answer may be largely moot, since either standard makes it very difficult to overturn an arbitral award.
