Texas High Court Limits Extrinsic Evidence in Duty-to-Defend Analysis

There is a high-stakes game going on, pitting insurance companies against their policyholders in a series of important coverage issues pending before the Texas Supreme Court. And the first point has gone to the insureds. In GuideOne Elite Insurance Co. v. Fielder Road Baptist Church, the court decided that the insurance company must defend its policyholder against a suit, even if extrinsic evidence exists that may show the insured's liability policy doesn't cover the alleged wrong.
