Boston Federal Prosecutor Faces Disciplinary Hearing

A three-judge panel will hold a hearing Friday to determine whether Boston federal prosecutor Jeffrey Auerhahn should be disciplined for allegedly withholding exculpatory evidence, which forced another federal judge to release purported mobsters from prison. Auerhahn's alleged misconduct conduct occurred between 1991 and 1993 and was disclosed to the court in August 2002. Chief Judge Mark Wolf sparked the disciplinary case against Auerhahn by making a complaint to the Massachusetts Bar Counsel.

Theories vary as to why, but it might be that smaller firms are just more up-front about the numbers of gays and lesbians in their workforce. A Seyfarth Shaw associate on the board of the National Lesbian and Gay Law Association says that, at a large firm, there is "an incentive to not be 'out' at work."
