Chevron will get its hands on only part of the documentary footage that it sought to defend itself in Ecuadorian toxic tort litigation. The company's Gibson Dunn lawyers say they still expect to find a "treasure trove" of plaintiffs counsel misconduct.

At a hearing Wednesday, the judge seemed impatient--even angry--with lawyers who asked him to stay his ruling ordering filmmaker Joseph Berlinger to turn over 600 hours of raw footage from his movie about the Lago Agrio litigation to Chevron defense lawyers. The case, he said, would be decided on the law, not influenced by a celebrity letter-writing campaign against his previous ruling.

At least one of the judges considering whether a book inspired by The Catcher in the Rye constitutes copyright infringement admitted that he thought the book was "dismal." But the appellate panel suggested that the federal district court that enjoined publication in the U.S. may need to hear more evidence.
