3rd Circuit: P.I. Suit Deadline Tolled When Claim Filed in Wrong Court
New Jersey's statute of limitations is tolled for a personal injury plaintiff who mistakenly sues in a court that lacks jurisdiction over the defendant, says the 3rd Circuit. The court predicted that the New Jersey Supreme Court would allow equitable tolling in such a case if doing so "would not offend the goals of the limitations statute."
