O'Connor: Supreme Court Rulings Shouldn't Differ Based on Who Sits on Court

Retired Justice Sandra Day O'Connor says the Supreme Court should generally follow its prior rulings so the public has confidence that laws do not change just because justices come and go. In a broadcast interview, O'Connor responded to a question about the public's perception that the Court based its decisions more on politics than principle, calling that belief "a concern." The law "shouldn't change just because the faces on the Court have changed," she said.

Death penalty case holds up nominee for 2nd Circuit

In 2005, U.S. District Judge Robert Chatigny warned a defense lawyer of dire consequences if the lawyer did not do more to try to delay the execution of his client. The incident sparked a judicial ethics investigation of Chatigny, who sits in the District of Connecticut. Although the judge was cleared of misconduct and he apologized to the defense lawyer, Republicans are reviewing the case as they weigh whether to support Chatigny's nomination for a seat on the U.S. Court of Appeals for the 2nd Circuit.
