A federal jury in West Virginia has found C.R. Bard liable for injuries caused by its vaginal-mesh implant in the bellwether trial of a massive multidistrict litigation. Nelson Mullins Riley & Scarborough is serving as lead defense counsel for Bard.

Deciding Jurisdiction in Patent Appeals

In Holmes Group Inc. v. Vornado Air Circulation Systems Inc., the U.S. Supreme Court vacated a ruling that Federal Circuit jurisdiction can be based on a patent law counterclaim. Vornadomay cause strategic forum shopping, pleading strategies and races to the courthouse, since plaintiffs will now have more ability to direct their non-patent claims to the circuit courts of appeals of their choosing.

Jury Finds Johnson & Johnson Violated Patent Held by Cancer Specialists

Johnson & Johnson violated a patent for an implant used in breast cancer detection that was held by two Florida breast cancer specialists, according to a federal jury that ordered the company to pay the pair $2 million. The New Jersey-based company must also agree to give surgeon John Corbitt and physician assistant Lori Leonetti 10 percent of an estimated $39 million in annual revenue from the implant if Johnson & Johnson wants to continue selling it, the jury said Wednesday in its verdict.
