After a three-judge appellate panel reinstated a property owner's class action alleging that oil and chemical companies contributed to Hurricane Katrina's ferocity, the Fifth Circuit granted the defendants' motion to rehear the case en banc. Then, because it couldn't muster enough judges to hear it, the appellate court dismissed the appeal.

When House Majority Leader Rep. Richard K. Armey (R-Tex.) spoke on the Y2K liability bill in May, just before the House passed it 236-190, he depicted the plaintiffs' lawyers opposing the measure as "a bunch of buzzards and vultures [waiting] to feed off the carcasses." One or another tort reform proposal has been a nearly constant element on the congressional agenda. But measured by their own aspirations, Republicans have managed to enact little legislation on the matter.

Foreign Plaintiffs Can Bring Benlate Lawsuits in Delaware

The Delaware Supreme Court has opened the door to Benlate lawsuits against DuPont, producer of the controversial fungicide that is alleged in numerous lawsuits to cause birth defects. The court reversed a lower court's finding that a lawsuit brought on behalf of six children born in England, Scotland, Wales and New Zealand should be heard in those countries. The children suffer from severe eye defects allegedly caused by their mothers' exposure to Benlate.
