Microsoft Class Claims Questioned

A company set up to encourage consumers to take advantage of a billion-dollar class action settlement with Microsoft has hit a road bump. San Francisco Superior Court Judge Paul Alvarado said at a hearing last week that he's concerned about the way the Settlement Recovery Center is soliciting consumers to take part in the settlement. Microsoft argues that claims filed by SRC are invalid, but SRC contends Microsoft is trying to limit claims to hold on to some of the $1.1 billion in voucher funds.

Int'l Assoc. of Machinists and Aerospace Workers v. Werner-Matsuda expressly rejected the holding in Shurgard, which addressed "unauthorized access" in the context of employees who allegedly e-mailed their employer's trade secrets from the company computer to a direct competitor that was about to become their new employer. But Werner-Matsuda, says Nick Akerman, is unlikely to stem the growing use of the CFAA against employees and other insiders who steal computer data.
