Exxon Appeals $3.5 Billion Verdict
Exxon Mobil Corp. has asked the Alabama Supreme Court to overturn a $3.5 billion jury verdict, arguing that a state trial judge ran roughshod over the attorney-client privilege. By letting the state of Alabama introduce a memorandum prepared by an Exxon in-house attorney, the judge "ended any prospect of a fair trial for Exxon," the company claimed in its appellate brief.PwC Fights CPAs Over Trade Secrets
PricewaterhouseCoopers has turned to a Georgia judge for help against plaintiffs who are seeking not only $600 million in damages from the Big Four firm, but also its banishment from the state. Howard. "I've never had anything close to this before," said Howard, referring to the judge's banning of Dr. Larry R. Williams of Florida. A hearing on the mandamus matter is scheduled for Friday.Brothers' Racketeering Suit Seeks to Bring Down PricewaterhouseCoopers in Georgia
Stiles and Sammy Kellett, two Atlanta brothers, sold a national nursing home conglomerate to Mariner Health Group in 1995. That transaction is the basis of a high-stakes trial accusing PricewaterhouseCoopers and Mariner corporate officers of fraud and theft by deception constituting racketeering. The Kelletts are seeking treble damages of nearly $400 million and want to block PricewaterhouseCoopers from doing business in Georgia. But are the brothers naive locals or greedy, sophisticated businessmen? That was quick. On Wednesday, Bank of America and its counsel at Hunton & Williams sued Colonial Bank for $1 billion in mortgage loans that the beleaguered Alabama lender was holding in trust for a BofA subsidiary. On Thursday, Miami federal district court judge Adalberto Jordan granted BofA's motion for a temporary restraining order to keep Colonial from selling or otherwise disposing of 6,000 disputed mortgages.
