Sentencing Tops High Court's New Term
The Supreme Court returns to the bench Monday to set about cleaning up the sentencing system chaos it created in June. In a rare two-hour afternoon session, the Court will hear arguments in United States v. Booker and United States v. Fanfan, added to its docket in the aftermath of Blakely, which struck down a sentencing system similar to the federal one. Debate continues as to whether Justice Stephen Breyer -- who helped set the guidelines -- should participate.In what appears to be a case of first impression, the appellate court held that a federal judge cannot sanction a lawyer for conduct during arbitration.
