Forum for Academic and Institutional Rights et al v. Rumsfeld et al

Where the law schools have a policy of nondiscrimination based on sexual orientation, and the military excludes gays from serving, the statutory requirement that the schools must affirmatively assist military recruiters in the same manner as other recruiters in order to receive federal funding violates the schools' First Amendment protection; the schools have a reasonable likelihood of success on the merits and satisfy the other injunctive elements as well, and are entitled to a preliminary injunction.
