More than 2,000 janitors who claimed they were underpaid for their work at Albertsons, Ralphs Grocery Co. and Safeway's Vons supermarkets will share $22.4 million under a settlement approved Monday in federal court. The janitors, who were employed through a staffing agency, alleged the supermarkets knew they were not being paid proper wages. Some of the janitors claimed they were assigned to work seven days a week without overtime pay. Others were allegedly not paid minimum wage.Calif. High Court OKs State Misbranding Suit Over Pink Salmon
Plaintiffs lawyers scored a victory when the California Supreme Court ruled that private citizens can pursue suits against grocery chains that fail to label farm-raised salmon as artificially colored. In a unanimous ruling, the court rejected defense lawyers' arguments that the federal Food, Drug and Cosmetic Act preempts state laws regarding misbranding. Defense lawyer Rex Heinke said he was disappointed and might seek certiorari with the U.S. Supreme Court.Litigation Increased for Overtime Wage Claims
