11th Circuit Panel Bars Access to Firestone Files

The 11th U.S. Circuit Court of Appeals has ruled that court records sought by the media that include information about Bridgestone/Firestone Inc. tires will remain under seal. The ruling vacated a September 2000 ruling by a district court judge that would have opened the records in a South Georgia wrongful death suit to the news media, but the court did not permanently foreclose media access to the files.

In a hearing Tuesday before the federal judge in New York handling the WorldCom bankruptcy, Akin Gump Strauss Hauer & Feld withdrew its request for a $1 million retainer after it met opposition from the U.S. Trustee's Office and creditor Verizon Communications. The judge approved Akin Gump's application to be named counsel to the official committee of unsecured creditors in the bankruptcy after the retainer request was removed.

A Georgia Supreme Court ruling may mean investment managers carry much more liability risk than they previously thought. The justices reinstated a trial court's holding that Wachovia Bank of Georgia breached its duty to a client, former Iraqi general Ibrahim Namik Ali. Instead of following his request to place $2.65 million into U.S. government investments, the officials used a money market fund that led to what the client's heirs said were nearly $1.5 million in unnecessary estate taxes and fees.
